Accor\u00adding to Sec\u00adtion 12 of the Part-Time and Fixed-Term Employ\u00adment Act (Teil\u00adzeit und Befris\u00adtungs\u00adge\u00adsetz), it is pos\u00adsi\u00adble to agree work on call with an employee, mea\u00adning that the work can be per\u00adfor\u00admed accor\u00adding to the workload as ins\u00adtruc\u00adted by the employ\u00ader. Howe\u00adver, extre\u00adme cau\u00adti\u00adon is requi\u00adred when agre\u00ade\u00ading such on-call work:<\/p>\n<p>The agree\u00adment must con\u00adtain a spe\u00adci\u00adfic dura\u00adti\u00adon of weekly and daily working hours. If the dura\u00adti\u00adon of the weekly working time is not spe\u00adci\u00adfied, a working time of 20 hours is dee\u00admed to have been agreed. If the dura\u00adti\u00adon of the daily working time is not spe\u00adci\u00adfied, the employ\u00ader must uti\u00adli\u00adse the work per\u00adfor\u00admance for at least 3 con\u00adse\u00adcu\u00adti\u00adve hours. If, in addi\u00adti\u00adon, a mini\u00admum or maxi\u00admum working time is agreed for the dura\u00adti\u00adon of the weekly working time, the employ\u00ader may only call up to 25% of the weekly working time in addi\u00adti\u00adon or only up to 20% of the weekly working time less. It is the\u00adr\u00ade\u00adfo\u00adre cus\u00adto\u00adma\u00adry and advi\u00adsa\u00adble to agree on so-called time cor\u00adri\u00addors for on-call work, within which the call-off takes place.<\/p>\n<p><strong>Accor\u00addin\u00adgly, the Fede\u00adral Labour Court ruled on 18 Octo\u00adber 2023 \u2014 5 AZR 22\/23 that an employ\u00ader must pay 20 hours per week, even though the employee had work\u00aded fewer hours in accordance with the sta\u00adtu\u00adto\u00adry regu\u00adla\u00adti\u00adon. A devia\u00adting inter\u00adpre\u00adta\u00adti\u00adon of the agreed working hours could only be con\u00adside\u00adred in abso\u00adlut\u00ade\u00adly excep\u00adtio\u00adnal cases \u2014 the employ\u00ader would the\u00adr\u00ade\u00adfo\u00adre have to explain and prove why the working hours should excep\u00adtio\u00adnal\u00adly be less.<\/strong><\/p>\n<p><strong>The use of this fle\u00adxi\u00adbi\u00adli\u00adsa\u00adti\u00adon instru\u00adment can the\u00adr\u00ade\u00adfo\u00adre lead to unp\u00adlea\u00adsant con\u00adse\u00adquen\u00adti\u00adal costs if these sta\u00adtu\u00adto\u00adry pro\u00advi\u00adsi\u00adons are dis\u00adre\u00adgard\u00aded in the cor\u00adre\u00adspon\u00adding agree\u00adment.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Employ\u00aders par\u00adti\u00adcu\u00adlar\u00adly app\u00adre\u00adcia\u00adte it when they can deploy their employees fle\u00adxi\u00adbly.
